Former Embakasi MP Ferdinand Waititu has been accused of unlawfully acquiring a 50- acre piece land in Embakasi worth over Sh 1 billion.
Benson Ritho, a real estate developer went to court on Monday under a certificate of urgency, accusing Waititu of illegally acquiring his property despite orders from the court restraining any development on the land.
The judge presiding the case Pauline Nyamweya directed Ritho to serve Waititu with suit papers within a week.
The judge also ordered Ritho to publish in the local dailies an order that was issued two months ago restraining any one for developing, selling or alienating the disputed piece of land in Embakasi.
Ritho moved to court last year and sued Rangwe MP George Ogalo and his surveying company (George Systems) for allegedly subdividing and transferring his properties to third parties without his consent. Ogalo had been hired by Waititu to subdivide the land.
Ritho said Waititu obtained the land unlawfully saying he used his powers as an MP to bribe land officials at Ardhi House, Nairobi.
The case will be heard next month.
