The International Criminal Court (ICC) is misleading the Kenyan public on why the ICC Judge Christine Van Den Wynegaert pulled out from hearing the case against President Uhuru Kenyatta, his Deputy William Ruto and radio presenter Joshua sang.
In a shallow and less convincing statement on Monday, ICC President Judge Sang – Hyun Song lied to Kenyans that Judge Christine Wynegaert, who is a Belgian national , pulled out of the trial due to the Judge’s expected workload, as she was hearing five other cases including those of Libya, Cote d Ivore and Democratic Republic of the Congo.
But in her earlier statement, Judge Wynegaert personally questioned on how thoroughly the ICC Prosecutor had prepared for the Kenyan cases before bringing the charges against Uhuru and Ruto.
“I am of the view that there are serious questions as to whether the prosecution conducted a full and thorough investigation of the case against the accused prior to confirmation,” Judge Wyngaert said.
She also said the court‘s prosecution lacked enough evidence to prosecute Kenyan cases and the court is heavily relying on rumours other than actual facts as stipulated by the Rome Statute. Wynegaert requested the court to be excused from the Kenyan cases since they lacked a legal threshold to proceed to full trial.
Judge Wynegaert is also a Law professor at Antwerp University in Belgium.
